You further represent and warrant that you will not use, distribute, or permit the use of any product for human consumption, veterinary use, therapeutic use, diagnostic use, or any other unlawful or prohibited purpose. You agree to comply with all applicable federal, state, and local laws and regulations governing the purchase, possession, handling, storage, and use of the products offered through the Services.

Apex Peptides LLC reserves the right, at its sole discretion and without prior notice, to refuse, limit, or cancel any order if we believe that a purchase may violate these Terms of Service, applicable law, or the intended research-only nature of our products. In such cases, any payment received for an unfulfilled order will be refunded to the original method of payment.

Your purchases are subject to our Refund Policy and Shipping Policy, each of which is incorporated into these Terms by reference.

Apex Peptides currently ships only to addresses located within the United States. Orders are generally processed within one to two (1–2) business days, excluding weekends and holidays.

Shipping and delivery times displayed at checkout are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather conditions, incorrect customer information, or other circumstances beyond our reasonable control.

Risk of loss and title for products pass to you upon our delivery of the package to the shipping carrier. Customers are responsible for providing accurate shipping information. Additional information regarding shipping practices may be found in our Shipping Policy.

Apex Peptides is powered by Shopify, which enables us to provide the Services to you. However, all purchases made through this website are transactions solely between you and Apex Peptides. Shopify is not the seller of the products offered through this store and is not responsible for the products, their quality, safety, legality, or fitness for any particular purpose.

By using the Services, you acknowledge and agree that Shopify and its affiliates shall have no liability arising out of or relating to any transaction between you and Apex Peptides.

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

Without limiting the foregoing, you expressly acknowledge and agree that all products sold by APEX PEPTIDES are offered solely for lawful laboratory, scientific, and educational research purposes. APEX PEPTIDES LLC shall not be liable for any damages, losses, claims, injuries, or liabilities arising from or related to any use or misuse of its products in a manner inconsistent with these Terms of Service, including but not limited to any use involving human consumption, veterinary use, therapeutic use, diagnostic use, or any unlawful purpose.

SECTION 18 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Apex Peptides, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced.
